hundred and Ninety four Between Abraham Downer of Lampeter Township in Lancaster County and State of Pennsylvania Yeoman and Ann his wife, Martin Myer of Manheim Township in the County Aforesaid Yeoman and Ann his wife, Christian Myer of Warwick Township in the County Aforesaid yeoman and Elizabeth his [wife], Abraham Eby of Lampeter Township in the County aforesaid yeoman and Esther his wife, John Downer of Lampeter Township in the County Aforesaid Yeoman, David Downer by his Guardian Jacob Hartman of Lampeter Township in the County aforesaid, Daniel Downer by his Guardian Peter Eby of Warwick Township of the County Aforesaid, all of the one part, and Christian Downer of Lampeter Township in the County aforesaid Yeoman of the other part, Whereas Abraham Downer the Elder by Virtue of Sundry Deeds of Conveyance duly had and Executed became Seized of a Certain Tract of Land Situate in Lampeter in Lancaster County Containing Two hundred acres and allowances part of a Parcel of 5500 granted by William Penn unto Tobias Collett, Daniel Quare, Henry Goldney and the Heirs of Michael Russell by Patent of the 25th of 6th Month 1718 but as some of the Grantors through whose hand the aforesaid 200 acres of Land did pass were Aliens and born out of the Allegiance of the King of Great Britain whereby it became Necessary for the said Abraham Downer to Apply for and have a Patent of Confirmation which Obtained under the great seal of the Province of Pennsylvania bearing date the first day of July 1763 in which the aforesaid 200 acres and Allowance of Land Hereditaments and Appurtenances are released and confirmed to him the said Abraham Downer in Fee as in and by the same patent, Recorded in the City of Philadelphia in patent Book AA Vol 4 page 395 etc may appear, And Whereas Abraham Buckwalter and Mary his wife in and by their Indenture of Conveyance of the 28th of October 1783 did for the Consideration therein mentioned Grant release and Confirm unto the said Abraham Downer in Fee one hundred and forty Acres of Land by Certain Meets and Bound therein mentioned situate Contiguous to and Adjoining the Aforesaid Tract of Two hundred Acres and Allowances as by the same Indenture now produced and intended to be Recorded Doth Appear, And the said Abraham Downer being so seized died leaving to survive him a Widow six sons and three daughters having first made and published his last Will and Testament in writing wherein he Bequeathed his Real and Personal Estate to and Between his wife and nine children viz Abraham, Ann who intermarried with Martin Myers, Elizabeth who intermarried with Christian Myer, Christian, Esther who intermarried with Abraham Eby, John, Henry, David, and Daniel, to the four Eldest Sons he devised his Lands aforesaid and thereon nominats and Appoints his Friends Jacob Landas and Henry Landas whole and Sole Executors of his said Last Will and thereon also directs and empowers them to divide his Lands between his sons Aforesaid and make deeds to them of equal Validity as he might or could have done, Notwithstanding the said Executors delayed the Execution of that part of the Will Probably on account the Children were not all arrived to the Respective Ages before which period they were Summoned of the stage of Action whereby the said division and Confirmation by Title Deed means yet to be done which division since their decease has been made by the Legatees themselves, the Guardians of Minor Children, with the advice and Consent of their Friends, And is Considered that Releases from the several Legatees respectively to each other of those that hold Land by Virtue of said Will from those that receive Legacies in Cash may be save and Legal Mode of Procedure to answer the spirit and intention of the Testator and Confirm the Title Deeds to the Sons to whom the Lands were Literally Devised as he Valued Each Child's Land at a certain sum per Acre in Order to equal his Children as appears upon the face of Will which has been duly approved and remains on the Registers Office in and for the County of Lancaster as of Record, Now this Indenture Witnesseth that they the said Abraham Downer and Ann his wife, Martin Myer and Ann his wife, Christian Myer and Elizabeth his wife, Abraham Eby and Esther his wife, John Downer, Jacob Hartman and Peter Eby for an in Consideration of the sum of four hundred and ten pounds in gold and Silver Coin Current money in the State aforesaid to them in hand paid by the said Christian Downer at and before the Ensealing and delivery of these presents the receipt and payment whereof they do hereby acknowledge and Confess themselves therewith fully satisfied Contented and paid, Have and each of them hath granted bargained and sold Aliened Enfoeffed released Quit claimed and Confirmed and by these Presents Do and each of them Doth grant Bargain and sell Alien Enfeoff Release Quit Claim and Confirm unto the said Christian Downer and his heirs All that the following described Tract and parcel of Land Situate in Lampeter Township aforesaid, Beginning at a Black Oak in the antient(?) Boundary line Thence North nineteen degrees west thirty six perches to a white oak in a line of John Downer Land, thence by the same south seventy three degrees and a half East fourteen perches to a white oak and South eighty seven degrees and three quarters East one hundred and fifteen perches to a post a Corner of Abraham Downers Land thence south ten degrees East forty six perches to a post and north Seventy two degrees West seventeen perches to a post and South eighty two degrees west five perches and a half to a post and south twelve degrees and a half East fifty six perches and a half to a stone and south seventy eight degrees West six perches to a stone and south twelve degrees and a half East twenty eight perches to a stone and south seventy seven degrees west twenty four perches to a Black Walnut tree, thence South twelve degrees and a half West one hundred and eighteen perches to a post near a white oak thence south seventy three degrees and a half west sixty eight perches and three quarters to the place of Beginning, Containing forty two acres and twenty six perches, It being part and parcel of both the above mentioned large tracts, Together with all and singular the houses outhouses Edifices and Buildings thereon erected and being Woods underwoods ways waters water curses hedges ditches trees fences gardens orchards fieldings commons pastures lights rights Easements and Appurtenances to the same belonging or in any wise appertaining and the Reversion and Reversions Remainders Rents Issues and profits thereof and all the Estate right Title Interest use Trust Property Possession Claim and demand whatsoever both at Law and in Equity or otherwise howsoever of them the said Abraham Downer and Ann his wife, Martin Myer and Ann his wife, Christian Myer and Elizabeth his wife, Abraham Eby and Ester his wife, John Downer, Jacob Hartman and Peter Eby of in to and out of the same and every or any part thereof, To Have and to hold the above described Tract piece and parcel of Land hereditaments and Premises hereby granted and released or meant mentioned or intended so to be and every part thereof with the Appurtenances unto the said Christian Downer his heirs and Assigns to the only proper use benefit and behoof of him the said Christian Downer his heirs and Assigns forever, So that neither they the said Abraham Downer nor Ann his wife Martin Myer nor Ann his wife Christian Myer nor Elizabeth his wife Abraham Eby nor Ester his wife John Downer Jacob Hartman nor Peter Eby nor their nor any of their heirs nor any other Person or Persons for them of in their names or in the name right or Stead of any of them shall or will by any ways or means hereafter have claim Challenge or demand any Estate Right Title or interest of in or to the said Premises or any part thereof, but from all and every Action right estate Title Interest or demand of in or to the said Premises or any part thereof they and every of them shall be utterly excluded and barred forever by these presents, And that they the said Abraham Downer and Ann his wife Martin Myer and Ann his wife Christian Myer and Elizabeth his wife Abraham Eby and Esther his wife John Downer Jacob Hartman and Peter Eby and their heirs and all and every other Person and Persons and his and their heirs any thing having or claiming in the said Premises above mentioned or any part thereof by from or under them or any or either of them shall and will from time to time and at all times hereafter upon reasonable request and at the proper costs and Charges in the Law of the said Christian Downer his heirs or Assigns make do and execute or cause and procure to be made done and executed all and every such further and other lawful and reasonable Act and Acts thing and things devise and devises in the Law whatsoever for the further better and more perfect granting Conveying and Assuring of all and Singular the said Premises above mentioned with the Appurtenances unto the said Christian Downer his heirs and Assigns to the only proper use Benefit and behoof of the said Christian Downer his heirs and Assigns forever as by him the said Christian Downer his heirs or Assigns or his or their Counsel Learned in the law shall be reasonably devised or advised and required. In Witness whereof the Parties to these Presents their hands and seals hereto interchangeably have set and dated the day and year first above written. Personally came before me the Subscriber one of the Justices of the peace in and for said County Abraham Downer and Ann his wife, Martin Myer and Ann his wife, Christian Myer and Elizabeth his wife, Abraham Eby and Esther his wife, John Downer, Jacob Hartman and Peter Eby grantors and Releasors above named and produced the above Indenture which they severally Acknowledged to be their act and deed to the intent the same may be admitted upon Record as such, the said Ann Downer, Ann Myer, Elizabeth Myer and Esther Eby the several wives of the Grantors aforesaid being severally arrived to their respective age, and by me privately and apart Examined Voluntarily thereof did Consent, the Content being first made known to them. | Probate* | 17 November 1796 | His estate was probated on 17 November 1796 at Lancaster Co., Pennsylvania; Wills E-389 - The Last Will and Testament of Abraham Downer of Lampeter Township Lancaster County, Yeoman, Deceased, having been written in the German language and therefore could not be recorded, but thereon is Endorsed as follows, to wit, Lancaster County, to wit, On the Seventeenth Day of November Anno Domini 1786 Before me the Subscriber personally Appeared Abraham Buckwalter and Henry Buckwalter the two subscribing witnesses to the foregoing will and codicil and on their Solemn Affirmations According to Law did declare Affirm and say, that they were present and saw and heard Abraham Dauner the Testater above named Sign Seal publish pronounce and declare the foregoing writing as and for his last will and Testament, and the writing thereunto Annexed as and for a Codicil to the same, and that at the signing severally he was of sound and will disposing Mind Memory and understanding to the best of their Knowledge Observation and Belief. Be it remembered that on the Seventeenth Day of November Anno Domini 1786 The Last Will and Testament of Abraham Dauner late of Lampeter Township yeoman deceased Together with Codicil thereunto Annexed was proved in due form of Law and Letters Testamentary thereon were granted unto Jacob Landis and Henry Landis Executors in the same will named, they having first been duly qualified well and truly to administer the Estate of the said deceased and especially to Exhibit a true and perfect Inventory thereof into the Registers Office at Lancaster within one Month from this date and to render as Just and true account of the Administration on said Estate within one year or when thereto lawfully required.
