     Timothy Crosthwait - do hereby make my last will & testament in the manner following that is to say
     I leave & bequetath to my brother William Crosthwait all & hail my lands lying in Culpeper County as also one tract of land in Spotsylvania County containing 150 acres more or less which is to be his share of my whole estate.
     I leave & bequeath to Abram Crosthwait my brother one tract of land in Orange County containing 100 acres less or more joingin Mr Alex Marr & Erasmus Taylor which is to be his whole share of my estate.
     And as to my movable estate I have in the following manner after all my just debts are paid out of it vis
     I leave & bequeath to my brothers Isaac & Jacob Crosthwait equally one half of my moveable estate after paying my debts above. Thhat is to say one fourth part to each.
     I leave & bequeath to my sister Sarah spouse to John Thomson three eights part of my moveable estate as above and the remainder one eighth part I leave & bequeath to my sister Elizabeth spouse to Jacob Medley and I likewise order that my negro wench Phillis be sold and be reconed as part of my moveable estate and I desire that my brothers William & Abram be my executors as also Peter Tucker and M Erasmus Taylor be likewise executors.
     And this I herby declare to be my last will and ___ [it doesn't say testament] as above.
     As witness my hand this 15th day of June 1756.

At a court held for Orange County on Thursday, the 26th of August, 1756, This Last Will and Testament of Timothy Crosthwait dec'd was presented into Court by Abraham Crosthwait one of the Exors therein Named Aproved by the oaths of Andrew Shepherd and Alex'r Marr, witnesses thereto and Ordered to be Recorded on the Motion of the said Abraham who made Oath according to Law Certificate is granted him for obtaining Letters of probate thereof in due form giving Security on which he with Joseph Eve his Security entered into and Acknowledged their Bond according to Law in the Tune of Lb. 250 Curt. money.

     There is a typescript of the inventory on pg 19 of Crostwaite book
     Seems to have been unmarried since he left estate to his siblings, with no mention of a wife or children.1

     Wm Crosthwait In the Name of God amen. I William Crosthwait of Bromfield Parish in ye county of Culpeper being well in health and of Perfect mind & memory but knowing the certainty of death and uncertainty of the Hour and Time, do therefore make this my last will and Testament, and after recommending my Body to ye Earth to be Buried at ye Discretion of my Executors here after nam'd & my soul to God who gave it me with all worldly Estate it hath Pleas'd him to endow me with I dispose of it in mannor and form following Viz
     First and Principally, I desire that all my just Debts may be punctually paid
     Secondly, I lend to my loving wife the use of all my Personal Estate during her Widowhood (Except a Slave a Piece to be lent to each of Children as they come of age.
     Thirdly, It is my desire that as soon as my youngest son or daughter living that come of age, that all my Personal Estate be Equally Divided amongst what Children I have then living (Except my wife's dower which is likewise to be Equally Divided between them at her death.
     Also, It is my Desire that when my youngest son or daughter comes of age that ye Land whereon I now live may be sold and the money Equally divided between my two sons Jacob and William Crosthwait.
     And Lastly I nominate and appoint Mr. Joseph Early, Majr. James Barber (?), Mr. John Terril Executors and my wife Milley Executrix of this my last will and testament, and I do hereby utterly revoke, disannul all former Bequests, wills and Legacies by me heretofore in any wise left or made, declaring, ratifying and Confirming this and no other to be my last will and Testament In Witness whereof I have hereunto set my hand and Seal this Tenth day of July one Thousand Seven Hundred and Seventy

At a Court held for the County of Culpeper on Monday the 15th of April 1771 This last Will and Testament of William Crosthwait decd was this day Exhibited to the court by Milly Crosthwait widow and Relect of the said decedient and one of the Excors herein named and was Proved by the oath of Jonathan Cowherd and William Bates Witnesses thereto and to be recorded and on his motion Certificate is Granted her for obtaining a probat whereof in due form she having Sworn is the same and given Bond and Security according to Law Liberty being Reserved for the other Exor's to join in this Probat when they shall think fit.
